本文旨在透過聯合國身心障礙者權利公約（下稱「CRPD」）第 12 條及 CRPD 第 1 號一般性意見對該條所為之闡釋，輔以對德國成年輔助法之比較法觀察，檢視我國成年監護制度下監護人之人身照護職務相關規範，進而討論複數監護人間、監護人與保護人間、監護人與醫療委任代理人間之互動關係，並提出相關修法建議。 首先，在我國成年監護制度下，民法對於監護人之人身照護職務相關規範明顯不足，而須仰賴安寧緩和醫療條例、病人自主權利法及精神衛生法等特別法之規範，故本文分別就上開規範中所設之監護人、醫療委任代理人及保護人制度加以說明，並說明家事事件法中監護宣告事件及保護安置事件之程序規定。 再
